Notice Regarding Software and Content
Use of the TumbleReader™ software application, Tumblebooks.com, Tumbleweed-Press.com, 10BelowZero.com and KidContent.com ("the Content Providers") is subject to the following terms.

Any software, logos, graphics, image, sound, text or other content ("the Content") that is made available through the Content Providers is the copyrighted work of TumbleBooks Inc., its affiliates, or suppliers. Use of the Content is governed by the terms of the end user license agreement ("the License Agreement") if any which has been made available and these Terms of Use.

The Content is made available for downloading and via the Internet solely for personal use by end users according to the License Agreement and these Terms of Use. Any reproduction, redistribution, or manipulation of the Content other than as permitted by the Terms of Use is expressly prohibited by law and may result in severe civil and criminal penalties. Violators will be prosecuted.

By accessing the Content Providers the user acknowledges this notice and agrees to the Terms of Use.

Trade Marks and Copyrights — All Rights Reserved
TumbleBooks Inc. or its affiliates own and operate the Content Providers and all related words, domain names, logos, trade marks, text, images, graphics, sounds, devices and processes, characters, and proprietary colors, are copyright and trade mark property of TumbleBooks Inc. or its affiliates.

The use of certain names, titles, characters, phrases, logos, designs, graphics, icons, and trade marks displayed by the Content Providers may constitute registered or unregistered trade-marks of the Content Providers or their affiliates or third parties. The display of third party trademarks by the Content Providers does not imply that a license of any kind has been granted. Unless otherwise specified, downloading, retransmission or other copying, modification or exploitation of any trade mark, copyrighted material or other Content displayed by the Content Providers constitutes a violation of federal or common law and is prohibited. In addition, the respective web sites of the Content Providers are protected by copyright as collective works and/or compilation, pursuant to Canadian copyright laws.

No Copying
Unless otherwise specified, no Content provided by the Content Providers or any web site owned, operated, licensed or controlled by the Content Providers or their licensees, may be copied, reproduced, republished, posted, transmitted, or distributed in any way. The use of any of the Content in any manner or format or its modification, distribution, republication or any other use without the prior written permission of TumbleBooks Inc. is strictly prohibited.

Disclaimer and Limitation of Liability
The Content is provided on an "as is" basis and TumbleBooks Inc. makes no representations or warranties, either express or implied, of any kind with respect to the Content and disclaims all warranties, express or implied, including, but not limited to, the merchantability and fitness for a particular purpose. By using the Content the user acknowledges that TumbleBooks Inc. makes no warranties or representations regarding the Content and that (I) there are no warranties or representations made regarding the Content and (II) as a service to users the Content Providers may include links to other web sites over which the Content Providers have no control and provide no endorsement or representation of any kind regarding the products, services, content, or appropriateness of content of such web sites, beyond reasonable inquiries to determine if they are safe and appropriate for use and viewing by children under the age of 16.

Content Provided by Users
You acknowledge that any content, offers, information, opinions you may provide to the Content Providers becomes the property of TumbleBooks Inc., including all copyright, without reservation, and you waive all rights in favor of TumbleBooks Inc. You acknowledge that all or any portion of the content may be used, edited, reproduced, published, translated, sublicensed, copied and distributed and/or incorporated into other works in any form, media, or technology for the full terms of any copyright that may exist in such content, without compensation of any kind to the user. This condition does not apply to manuscripts or illustrations or like material being submitted on a commercial basis.

Jurisdiction of Ontario
The Terms of Use is governed by the laws of the Province of Ontario, Canada. Each of the parties to this agreement irrevocably attorns to the jurisdiction of the courts of Ontario and further agrees that any litigation, arbitration, or other dispute resolution process shall be conducted exclusively in the Judicial District of York, Province of Ontario. You hereby submit to the exclusive personal jurisdiction and venue of the courts of the Province of Ontario and do so voluntarily.

Privacy and Safety Policy
The Privacy and Safety Policy published by the Content Providers form part of the Terms of Use.
